Terms of Use

1. General

By agreeing to these Terms, you are deemed to have agreed to be bound by all provisions herein.

These Terms of Use (these “Terms”) set forth the conditions for use of the service (the “Service”) provided by the developer of “PomoMon” (the “App”) (the “Developer”). By downloading, installing, or using the App, you are deemed to have agreed to these Terms.

Handling of personal information in the App is governed by the Privacy Policy. If these Terms and the Privacy Policy conflict regarding personal information, the Privacy Policy prevails.

If you do not agree to these Terms, please stop using the App.

2. Definitions

• User: an individual or entity that uses the App
• Content: information, images, text, audio, data, and other materials displayed or provided in the App
• Digital items: in-game data such as monsters, collections, and serial information obtained and displayed in the App
• Mana: in-game currency usable only within the App
• Gacha tickets: rights granted through play such as focus sessions and consumed to perform gacha draws
• Paid services: services purchased through the App Store, such as Premium (monthly subscription)
• Display name: a name set during initial setup or similar that is shown to other users
• Intellectual property rights: copyrights, patent rights, utility model rights, design rights, trademark rights, and other intellectual property rights

3. Conditions of use

3.1 Eligibility

You may use the App only if you meet all of the following.

• You understand and can comply with these Terms
• You will not use the App for purposes that violate applicable laws
• You can use focus work and break reminders safely and with consideration for others

3.2 Description of the Service

The App provides personal task management and focus support, a Pomodoro timer, monster collection, gacha, earning and spending mana, viewing and posting on the acquisition timeline, focus BGM, Live Activity, and related features. Available features and benefits may differ depending on paid service enrollment, ad viewing, and similar factors.

Except as permitted by the Developer or law, you may not copy, modify, redistribute, sell, sublicense, or otherwise exploit the App itself.

3.3 Account

To use certain features (obtaining digital items, posting to the timeline, etc.), you must complete required initial setup, such as registering a display name or starting as a guest. You are responsible for managing your device and related access.

The App manages data using identifiers tied to your device. Data may not transfer, or may be overwritten, when you change devices, reset them, reinstall the App, or restore device backups. Whether and how data transfers follow in-app displays and methods separately defined by the Developer.

Changing your display name may be subject to limits (such as change intervals). Display names are used for displays to other users, including on the acquisition timeline.

4. Prohibited conduct

You must not engage in the following when using the App.

• Infringing copyrights, trademarks, or other intellectual property rights of the App
• Reverse engineering, decompiling, or disassembling the App (except as permitted by law)
• Unauthorized copying, modification, distribution, sale, or transfer of the App
• Interfering with normal operation of the App
• Harassing or harming other users or third parties
• Violating laws or public order and morals
• Illegal acts using the App
• Circumventing security features of the App
• Imposing excessive load on the App or related servers or networks
• Using cheats, bots, unauthorized programs, or other methods the Developer deems inappropriate
• Improper use of multiple accounts, impersonation, or misuse of display names
• Setting display names that infringe third-party rights or are discriminatory, defamatory, obscene, or likely to be so
• Unauthorized acquisition or transfer of mana, gacha tickets, digital items, etc., or exchanging or selling them for cash outside the App
• Any other conduct the Developer deems inappropriate

If you violate the above, or the Developer reasonably believes you may, the Developer may take necessary measures, including changing or suspending your display name, suspending your account, or deleting data.

5. Intellectual property

Intellectual property rights in the App and related content (including app icons, monster images, egg images, characters, illustrations, BGM, UI, and programs) belong to the Developer or rightful owners.

You may not copy, modify, publicly transmit, republish, or create derivative works from such content without the Developer’s prior written consent.

Even if you obtain mana, gacha tickets, digital items, etc., you receive only rights limited to use within the Service; ownership or other intellectual property rights are not transferred to you.

6. Mana, gacha, and collection

6.1 Mana

Mana is in-game currency usable only within the App. It cannot be exchanged for cash or other property, refunded, or transferred outside the App. How mana is earned, spent, and capped follows in-app displays and rules set by the Developer.

6.2 Gacha

Gacha is a lottery feature performed by consuming gacha tickets granted through play such as focus sessions. Draw processing runs on your device. Results are determined by random numbers, etc., and specific rarities or digital items are not guaranteed. Details such as conditions, contents, and rates are shown in the App.

Performing gacha may require communication to confirm and apply results. If the network is unstable or unavailable, gacha tickets may be consumed without results being applied, or tickets may expire or become invalid without allowing another draw, which may disadvantage you. Unless the Developer acts intentionally or with gross negligence, the Developer is not liable for such matters.

The Developer may change gacha contents, grant conditions, mana amounts, and related specifications to maintain game balance, comply with laws, or for operational needs.

6.3 Collection

Digital items you obtain are displayed in collections and similar areas within the App. Some digital items may be assigned serial numbers.

When you newly obtain eligible digital items, your display name and acquisition details may be published to other users on the acquisition timeline, depending on your settings.

6.4 Loss of data

Mana, gacha tickets, digital items (including collections), task records, and other game data may be lost or become unavailable due to termination of the Service, account deletion, device failure, loss, or reset, deletion or reinstallation of the App, communication failures, system failures, or other causes not attributable to the Developer. The Developer does not guarantee permanent storage of such data.

7. Paid services

7.1 Contents

The App offers paid services such as Premium (monthly subscription). Benefits may include, for example (actual contents follow product descriptions on the App Store and in-app displays):

• Removal of in-app advertising
• Always-on ad-viewing boost
• Extended focus timer limits
• Removal of task creation limits and task archive features
• Automatic grant of break bonuses (such as gacha tickets)
• Other premium benefits shown in the App

7.2 Purchase and billing

Purchase, payment, auto-renewal, cancellation, and refunds for paid services follow Apple Inc.’s App Store terms and related policies. Prices, billing cycles, and displayed prices follow the App Store. Monthly subscriptions renew automatically at the end of each billing period unless you cancel.

Manage or cancel subscriptions through iOS Settings or other methods specified by Apple. After cancellation, premium benefits may continue until the end of the paid period. After that period ends, benefits end and free-tier conditions apply.

7.3 Restore purchases

If you need to restore paid service status after changing devices, use “Restore Purchases” or similar features in the App as specified by Apple. Whether restoration succeeds depends on Apple’s specifications and your App Store account status.

7.4 Refunds

Refunds for paid services generally follow Apple’s refund policy; the Developer does not handle refunds directly.

7.5 Changes and discontinuation

The Developer may change or discontinue paid service contents, prices, or conditions for legal compliance or operational needs. We will endeavor to notify you in the App or on this website before material changes.

8. Advertising

Users who have not subscribed to paid services may see third-party ads in the App (such as reward and interstitial ads). Subscribers may not see in-app ads.

Reward ads may grant benefits such as gacha boosts or break bonuses only when conditions such as completed viewing are met. Benefits may not be granted due to ad load failures, interrupted viewing, or device or network conditions.

The Developer does not guarantee the accuracy, legality, or usefulness of ad content, links, or advertised products or services. Direct inquiries about ads to the ad provider or linked business.

9. Account deletion

You may delete your account through the designated process in the App. Deletion cannot be undone.

Deletion generally removes the following.

• On-device app data
• Mana, digital items (collections), and profile information
• Task records
• Game data linked to you stored in the cloud

However, content posted to the acquisition timeline may remain. In that case, the display name on such posts may be changed to a label such as “Deleted user” as determined by the Developer.

Deleting your account does not cancel a paid subscription. Cancel subscriptions separately through methods specified by Apple.

10. Disclaimer

Except where the Developer acts intentionally or with gross negligence, the Developer is not liable for damages arising from use of the App. Where disclaimers are limited by the Consumer Contract Act or other laws, those laws apply.

10.1 Provision of the Service

The Developer does not guarantee continuous provision of the App. Features, contents, and specifications may be changed, suspended, or discontinued without notice.

10.2 Accuracy of timers and notifications

The Developer does not warrant the accuracy, completeness, or usefulness of timers, notifications, focus and break guidance, Live Activity, or similar features. They may not work as expected due to OS power settings, notification permissions, or device state.

10.3 Technical issues

Unless the Developer acts intentionally or with gross negligence, the Developer is not liable for data loss, communication failures, system failures, or cloud service malfunctions. The same applies to game data loss under Section 6.4 and loss or invalidation of gacha tickets due to communication issues under Section 6.2.

10.4 Third-party services

The Developer is not liable for issues arising from third-party services such as the App Store, Firebase, or ad networks used by the App.

10.5 Scope of damages

Even when the Developer is liable, liability follows applicable law and, except as permitted by law, excludes indirect, incidental, special, or atypical damages regardless of foreseeability.

11. Changes and termination of the Service

11.1 Changes

The Developer may change App features and contents for technical improvement, legal compliance, security, or other reasonable reasons.

11.2 Termination

The Developer may discontinue the App when unavoidable circumstances arise. We will notify you in advance where possible, but may discontinue without prior notice in emergencies. Upon termination, mana, gacha tickets, digital items, task records, etc. may become unavailable as stated in Section 6.4.

12. User responsibilities

You are responsible for the following regarding use of the App.

• Complying with these Terms and applicable laws
• Using the App at your own judgment and risk
• Compensating third parties for harm you cause through use of the App
• Not using the App inappropriately while driving, during dangerous work, or in other unsafe situations
• Content of information shown to other users, such as display names and timeline posts

13. Exclusion of antisocial forces

You represent and warrant that you are not, and are not involved with, organized crime groups, members, associates, related companies, corporate racketeers, or similar parties (collectively, “antisocial forces”).

If the Developer determines that you are or are involved with antisocial forces, the Developer may suspend use or delete your account without prior notice.

14. Changes to these Terms

The Developer may change these Terms as needed. Revised Terms take effect when posted on this page. For material changes, we will endeavor to notify you in advance through in-app notice or similar means. Continued use after changes constitutes acceptance. If you do not agree, please stop using the App.

15. Governing law and jurisdiction

15.1 Governing law

These Terms are governed by the laws of Japan.

15.2 Jurisdiction

Disputes relating to these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

16. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect.
